Main duties of the job

Together with the Executive Medical Director and Associate Director of MACE, the Mental Health Law Manager has a lead operational responsibility to support clinical teams in compliance with all aspects of the Mental Health Law, (Mental Health Act (1983) (as amended in 2007) and the Mental Capacity Act (2005), including Deprivation of Liberty Safeguards (2009)). The post holder will do this by ensuring the development of systems and processes within the immediate mental health law team and across clinical teams and corporate services in order to support underpinning assurance and inspection activities, such as those directed by the Care Quality Commission and internal and external auditors.

The Mental Health Law Team Manager will join the current team working within the Mental Health Law Team. You will provide the day to day management of the Trust mental health law team members, providing support and guidance where needed.

The role is to ensure strong governance in relation to the use and application of mental health law. The Team Manager role is key in supporting inspection and assurance activities; specifically those undertaken by the Care Quality Commission [CQC].

There is an expectation that you participate in the delivery of training and education to staff as well as receiving it and you will also participate and on occasions lead clinical audit activity.

We are continuing our journey to provide more integrated services supporting a new alliance of health & care providers including mental health, primary care, community services, acute services, social care & voluntary sector. Job responsibilities

Some of the Key Responsibilities are:

  • Responsible for providing accurate and effective management, implementation and administration of the Mental Health Act 1983 and all related legislation on behalf of the Trust.
  • To provide leadership and support to the Trusts Mental Health Law Administration team, ensuring that the Trust operates in accordance with the requirements of the law and accepted good standards of practice.
  • To participate in the Trusts planning for the implementation of any legislative changes as required. To take the operational lead in planning for the implemented legislative changes, including the development of multi-disciplinary policies and procedures, introduction of new systems and devising required training for all levels of staff.
  • The post holder will be required to provide and receive complex, sensitive information and possess persuasive, motivational, negotiating skills. They will need to be confident in presenting information to large audiences as part of the Trusts mandatory and statutory training programme as well as communicating information to all levels of staff and family / carers, including external stakeholders.
  • To be able to interpret legal cases in relation to Mental Health Law in order to ensure up-to-date practice is complied with.
  • To be fully conversant with Trust policies in relation to Mental Health Law and take the operational lead on ensuring Trust policies are current and up to date and training for staff reflects current legislation. Thereby remaining up-to-date with key developments in mental health act law and policy and to act as a local focus point providing expert advice and guidance.
  • To analyse internal and external reports offering confirm or challenge e.g. Care Quality Commission, internal/external audit.
  • To work closely with local service and ward managers to support the implementation of the Act and to ensure that best practice is developed and maintained throughout the local area.
  • The post holder will be responsible for managing their own workload on a daily basis and prioritising those tasks requiring immediate attention.
  • To ensure that the team is adequately staffed at all times by monitoring staff sickness, absence and annual leave, to ensure that the needs of the service are met at all times.
